These terms and conditions govern the vehicle sourcing and buying services provided by SOURCESMART (“we”, “us”, “our”) to private customers and dealership used-car departments (“you”, “the customer”). By submitting a vehicle brief or engaging our buyer agents, you accept these terms.

SOURCESMART acts as a buying agent on your behalf. We source, assess and negotiate vehicles; we do not sell vehicles ourselves, and any contract of sale is between you and the vehicle’s seller.

After you submit a vehicle brief, a SOURCESMART buyer agent will contact you to confirm your requirements, budget and timeframe before any sourcing work begins.

We will present suitable vehicle options along with our assessment. You are under no obligation to purchase any vehicle we present, and we are under no obligation to accept every brief.

While we use our experience and market knowledge to seek the best possible outcome, specific savings, timeframes and vehicle availability cannot be guaranteed.

SOURCESMART works on a commission-only basis. Private customers pay a fixed commission of $1,000 AUD when they purchase a vehicle sourced by us. The fee is not calculated as a percentage of the vehicle price or the savings achieved.

The commission is deliberately set as a fraction of the benefit it exists to secure. Our sourcing target is $3,000 AUD or more below the price you would otherwise pay for the vehicle, so the commission is roughly a third of that reduction and around $2,000 AUD of it stays with you. Actual savings depend on the vehicle and market conditions and are not guaranteed. Your agent will explain the price comparison for any proposed purchase.

We set our fee this way because we are here to help you buy well: the value of the engagement is measured by what you save, not by the price of the vehicle. No commission is payable unless you proceed with a vehicle we have sourced for you — see section 5.

The commission arrangement for your brief is confirmed by your buyer agent and recorded on the agreement form you sign before you commit to any purchase.

For dealership used-car departments, sourcing is provided at a fixed rate per engagement, agreed in advance with your SOURCESMART agent.

Dealership engagements are confirmed on the same written agreement form supplied by your agent, and commission is payable once the vehicle has been bought and paid for.

Before any sourcing work begins, your SOURCESMART agent will supply a written agreement form for you to sign.

In simple terms, by signing you are confirming that you will pay the commission fee if a vehicle is purchased through our sourcing. Signing does not commit you to buying anything — it confirms that if you do go ahead and purchase a vehicle we have sourced for you, the commission set out on your form becomes your fee to pay.

Commission becomes payable once you have paid for the vehicle — that is, once you have accepted the vehicle and payment to the seller has been completed. If you do not proceed with a vehicle, no commission is payable and nothing is owed.

The signed agreement form sets out when and how commission is paid. If a purchase is cancelled, or a vehicle is returned or rejected after you have accepted it, the terms of your signed agreement form apply.

You agree to provide accurate information in your vehicle brief, including your budget and requirements, and to tell us promptly if your circumstances change.

You are responsible for satisfying yourself as to the condition and suitability of any vehicle before purchase. Where requested, we can assist in arranging independent inspections.

Any deposit or purchase payment for a vehicle is made to the seller under your contract with them, not to SOURCESMART, unless expressly agreed otherwise in writing.

To the extent permitted by Australian Consumer Law, SOURCESMART’s liability for any loss arising from our services is limited to the commission paid or payable for the relevant engagement.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law.

Information you provide in a vehicle brief — including your name, contact details, budget and vehicle requirements — is used only to action your brief and communicate with you about it. We do not sell or share your details with third parties except as needed to source your vehicle.

These terms are governed by the laws of Western Australia. We may update these terms from time to time; the version published on this page applies to engagements entered into from its date of publication.

If any part of these terms is found to be unenforceable, the remainder continues to apply.
